Risk Acknowledgment
Read this before subscribing to a coach. By subscribing, you confirm you've read and accept everything below — for yourself and, if applicable, for your minor athlete.
Why this matters
In short: Athletic and mental performance coaching carries real risk. This page exists so you can make an informed decision.
UniteHQ connects parents and athletes with independent coaches who provide athletic performance and mental performance coaching. Like any physical or psychological activity, coaching carries risk — sometimes serious. Subscribing to a coach is a decision that affects your athlete's body and mind, and we want you to make it with eyes open.
By clicking the acknowledgment box at checkout, you confirm that you have read and accept this Risk Acknowledgment. It is a legally binding part of your Terms of Service.
Physical activity and injury
In short: Strength training, drills, and athletic activity can cause injury, including serious injury. You assume that risk on your athlete's behalf.
Athletic training — including strength and conditioning, plyometrics, sport-specific drills, mobility work, and conditioning — carries an inherent risk of injury. Possible injuries include but are not limited to: sprains, strains, fractures, joint injuries, concussions, heat illness, dehydration, cardiac events, and, in rare cases, permanent disability or death.
You acknowledge these risks and accept them on behalf of yourself and, if subscribing for a minor athlete, on behalf of that athlete.
Mental performance is not therapy
In short: Mental performance coaching helps athletes focus, build confidence, and prepare. It is not therapy, counseling, or psychiatric care.
Mental performance coaching available through UniteHQ — including visualization, confidence work, focus routines, pre-game preparation, and similar — is performance coaching. It is not psychotherapy, counseling, psychiatric care, or any form of mental health treatment. Coaches on UniteHQ are not, in their UniteHQ capacity, providing diagnosis, treatment, or care for any mental health condition.
If your athlete is experiencing a mental health condition or crisis, please consult a licensed mental health professional. See Crisis resources below.
Medical clearance
In short: Get medical clearance before starting. Stop any activity that hurts. Consult a doctor about anything that doesn't feel right.
You represent that the athlete has received any medical clearance appropriate for their level of activity, that the athlete is in good physical condition, and that you are not aware of any medical condition that would make participation unsafe.
You agree to instruct the athlete to stop, modify, or skip any activity that causes pain or feels unsafe, and to consult a qualified physician with any concerns.
Parental supervision
In short: If subscribing for a minor, you (the parent) are responsible for supervising participation.
If you are subscribing on behalf of a minor athlete, you confirm that you are the parent or legal guardian and that you accept responsibility for supervising the athlete's participation, including reviewing programs, drills, video, and messaging provided by the coach.
No guarantees of outcomes
In short: Coaching can help. It can't guarantee scholarships, recruitment, performance gains, or any specific outcome.
Athletic and mental performance outcomes depend on many factors outside any coach's control. Neither UniteHQ nor any coach guarantees any specific outcome — including improvement in skill, performance, fitness, mental health, recruitment, scholarship, or selection for any team.
Assumption of risk
In short: You voluntarily assume the risks described above for yourself and your athlete.
You voluntarily assume the risks of participating in coaching activities offered through UniteHQ, including the risks of injury, illness, and emotional distress, on behalf of yourself and any minor athlete on whose behalf you have subscribed. This assumption of risk is intended to be as broad and inclusive as permitted by applicable law.
Release of UniteHQ
In short: To the extent allowed by law, you release UniteHQ from claims arising out of coaching activities provided by independent coaches on the platform.
To the maximum extent permitted by applicable law, you release, waive, and discharge Modern Day Sports LLC (doing business as UniteHQ), its affiliates, and their respective officers, directors, employees, members, managers, and agents from any and all claims, demands, actions, or causes of action arising out of or related to coaching services provided by independent coaches through UniteHQ, except to the extent caused by UniteHQ's gross negligence or willful misconduct.
Some jurisdictions limit pre-injury releases, especially for minors. Where local law limits this release, it applies to the maximum extent permitted by that law.
